ESA Law and Administrative Rules
The Empowerment Scholarship Account (ESA) program was passed in 2011 by the Arizona State Legislature. The Arizona Department of Education is responsible for administering the program according to the statute and Arizona State Board of Education rules. icon icon A.R.S. 15-2401 - This section of the ESA statute defines key terms referenced in the rest of the law as well as what constitutes a 'qualified school' and 'qualified student.'
icon icon A.R.S. 15-2402 - This section states how a qualified parent may apply and also states appropriate uses of the scholarship funds.
icon icon A.R.S. 15-2403 - Dictates administrative rules and oversight of the scholarship by the Arizona Department of Education & The Arizona State Treasurer's Office.
icon icon A.R.S. 15-2404- Sets forth the limits of control over non-public institutions by the department and other governmental agencies.
icon icon A.R.S. 15-2405- Requires ADE to contract with a third-party administrator to assist the department in the financial administration of ESAs.
